2. PURPOSE OF CONTRACT
This contract regulates the terms and conditions under which the SERVICE PROVIDER offers tourism services for tours and visits to the Paricutín Volcano area, located in Michoacán, Mexico.
3. ASSUMPTION OF RISK AND TOURIST RESPONSIBILITY
3.1 The TOURIST/VISITOR expressly acknowledges and accepts that the tour to Paricutín Volcano involves risk activities, including but not limited to: hiking on irregular terrain, ascending volcanic areas, exposure to variable weather conditions, and physically demanding activities.
3.2 The TOURIST/VISITOR participates in the tour AT THEIR OWN RISK AND RESPONSIBILITY, releasing the SERVICE PROVIDER from any liability for:
- Personal accidents
- Physical injuries
- Preexisting health problems or those arising during the tour
- Illnesses
- Loss or damage to personal belongings
3.3 The TOURIST/VISITOR declares:
- Being in adequate physical and health condition to perform the activities
- Not suffering from heart disease, respiratory problems, or any condition that could be aggravated by physical activity
- Having consulted with a physician if they have doubts about their physical condition
4. MEDICAL INSURANCE AND EXPENSES
4.1 The TOURIST/VISITOR is SOLELY RESPONSIBLE for having travel medical insurance or major medical expense insurance that covers any eventuality during the tour.
4.2 All medical, hospital, medication, emergency transportation, or any other expenses related to the TOURIST’s health shall be COVERED EXCLUSIVELY BY THE TOURIST/VISITOR.
4.3 The SERVICE PROVIDER assumes NO financial responsibility for medical expenses of any nature.
5. EXCLUSION OF LIABILITY FOR HORSEBACK RIDING
5.1 Horseback riding services are provided by INDEPENDENT THIRD PARTIES and are NOT part of the direct services of the SERVICE PROVIDER.
5.2 The SERVICE PROVIDER IS NOT RESPONSIBLE for:
- Accidents during horseback riding
- Injuries caused by falls or animal behavior
- Quality of service from horse providers
- Health condition or behavior of horses
- Capacity or experience of riding guides
5.3 The TOURIST who decides to take the horseback riding service does so at their exclusive responsibility and must contract directly with the equestrian service provider.
6. TOURIST OBLIGATIONS
The TOURIST/VISITOR agrees to:
- Follow guide instructions at all times
- Bring appropriate equipment (proper footwear, comfortable clothing, sun protection, water)
- Inform the guide about any relevant medical conditions
- Not perform actions that endanger their safety or that of other participants
- Respect environmental regulations and not damage the natural area
- Not be under the influence of alcohol or substances during the tour
7. CANCELLATIONS AND REFUNDS
7.1 Cancellations by the tourist:
- More than 48 hours in advance: 80% refund
- Less than 48 hours: no refund
7.2 The SERVICE PROVIDER reserves the right to cancel the tour due to adverse weather conditions or force majeure situations, granting a full refund or rescheduling.
8. JURISDICTION AND APPLICABLE LAW
8.1 This contract is governed by the laws of the United Mexican States, particularly:
- Federal Consumer Protection Law (Ley Federal de Protección al Consumidor)
- Federal Tourism Law (Ley Federal de Turismo)
- Federal Civil Code (Código Civil Federal)
- Applicable regulations of the State of Michoacán
8.2 Any dispute shall be submitted to the jurisdiction of the courts of Uruapan, Michoacán, Mexico, with the parties waiving any other jurisdiction that may correspond to them.
9. ACCEPTANCE OF TERMS
By contracting this service, the TOURIST/VISITOR declares:

✓ Accepting all risks inherent to the activity
✓ Releasing the SERVICE PROVIDER from liability under the terms established herein
✓ Having adequate medical insurance
✓ Being in suitable physical condition to perform the tour
